What We Do · Trusts

Gibraltar trustee services built on English trust law.

Gibraltar trusts are governed by the Trustee Act (based on English trust law) and offer internationally mobile families a flexible, discreet vehicle for wealth protection, succession planning, and inter-generational governance. Resilience Group acts as professional trustee and establishes private trust companies for clients who need a regulated, independent fiduciary in a common-law jurisdiction.

Scope

What this service covers

Four trustee services. Each may be provided independently or as part of a wider family-office engagement.

Professional trustee services

We act as professional trustee for discretionary trusts, fixed-interest trusts, and purpose trusts. All appointments carry full fiduciary duties and are subject to our standard due diligence before acceptance.

Private trust companies

For families with complex holdings or a desire for direct governance involvement, we establish and administer private trust companies that act as trustee — giving the family a governance role while preserving the legal benefits of the trust structure.

Trust administration

Maintaining trust records, preparing trust accounts, managing distributions, liaising with investment managers, and ensuring ongoing compliance with Gibraltar law and the terms of the trust instrument.

Protector and successor appointments

Where the trust deed provides for a protector, we can serve in that capacity or recommend independent appointees. We also accept appointment as successor trustee following due diligence on the existing structure.

What We Won't Do

Where we draw the line

Explicit scope-exclusion is more useful to a serious client than another positive claim. Here is what we will not take on.

We don't act as bare nominee trustee for assets we have not approved.

Trustee services are not appropriate where the settlor or beneficial owner expects to control trustee decisions directly. We do not accept appointment as nominee trustee for structures where real decision-making authority rests elsewhere. Every asset class is reviewed before acceptance, and a structure we cannot administer responsibly is one we will decline.

Process

How an engagement works

Four phases. Click a step to expand it.

Step 01 Understanding your objectives

We start with the substantive question — what is the trust for? Wealth protection across generations, succession, philanthropy, or a combination. The structural answer follows the objective, not the other way round.

Step 02 Legal structuring

Working with your legal advisers, we help determine the appropriate trust type, governing law, and governance framework. The trust deed is drafted by your lawyers — we provide practical structuring input and confirm what we can administer.

Step 03 Due diligence and appointment

Full CDD on the settlor, beneficiaries, and source of funds in line with GFSC requirements. For successor appointments, we conduct due diligence on the outgoing trustee and the asset schedule before accepting. Typically 2–3 weeks for straightforward structures.

Step 04 Ongoing administration

Annual trustee meeting, distribution review, investment oversight, accounts preparation, and CRS/FATCA reporting. A named trust officer is responsible for your structure throughout the relationship.
